Why You Need An Estate Plan - Don't Leave Decisions to Chance


While none of us like to dwell on our own mortality, failing to plan for incapacity or the inevitable can lead to significant personal and financial turmoil for your loved ones. That's why it's crucial to have a comprehensive estate plan in place that spells out your wishes regarding medical care and how you want your assets distributed. Without the proper documents, the state will decide what happens rather than your own carefully considered plans.

 

A key component is a Will, which allows you to designate how your property and other assets will be divided upon your death. If you have minor children, a Will is where you can nominate a guardian to care for them. Without a valid Will, your estate will go through the probate process following intestacy laws, which distributes your assets in a pre-determined way that may not align with your intent.

 

Equally important are powers of attorney for financial matters and health care decisions while you're still living. A Statutory Durable Power of Attorney allows you to name an agent to handle your financial affairs if you become incapacitated. Likewise, a Medical Power of Attorney authorizes someone to make medical decisions on your behalf if you are unable to do so yourself.

 

Speaking of medical issues, a HIPAA Authorization gives designated individuals the right to access your protected health information, which doctors and hospitals won't share without this document due to privacy laws. Finally, a Directive to Physicians (also called a Living Will) provides instructions to remove life-sustaining treatment if you are suffering from a terminal or irreversible condition.

 

While drafting this comprehensive collection of documents requires careful thought, the peace of mind is invaluable. Don't leave critical decisions about your estate, finances, health, and end-of-life care up to chance or state laws.
